This notice explains how KremsChem Austria GmbH, Hafenstraße 77, A-3500 Krems an der Donau (“we”) processes your personal data. In order to provide you with better orientation, the material sections of this notice are broken down by groups of data subjects. 1 What data do we process and in what manner?

1.1 Users of our website

When you visit a website that we operate, we will process some of your personal data in connection with this visit.

Section 2 explains how we process your personal data. Sections 2 and 1.1.4 also explain the transmission of personal data to other countries and your rights in connection with the processing of your personal data.

1.1.1 What data we process about you

We collect the following information automatically when you visit our website:

  • The website (URL) that you visited before calling up this page, certain cookies (see item 1.1.4)

1.1.2 For what purpose we process your data

We will process your personal data for the following purposes:

1.1.3 Legal basis for data processing

The legal basis for the processing of your personal data is our overriding legitimate interest (pursuant to Art. 6 [1] f of the EU General Data Protection Regulation), which consists of operating our website in a user-friendly manner and protecting it against attacks.

We will generally store your data for a period of 12 months. We will only store your data for longer when this is necessary to investigate attacks on our website, and beyond this only until the end of relevant statutory limitations or legal retention periods, or until the resolution of any legal disputes for which the data are required as evidence.

1.2 Employees of customers, suppliers, and business partners

As part of our business and serving our customers, we will process some of your personal data as an employee of one of our customers, suppliers, or business partners.

1.2.1 What data we process about you

As part of your employment by one of our customers, suppliers, or business partners, we will process the following personal data about you:

  • Reference number
  • Name
  • Salutation/gender
  • Associated customer/supplier/business partner
  • Contact data (e-mail address, telephone number, etc.)
  • Languages of correspondence, other agreements, and keys for data exchange
  • Function at the customer/supplier/business partner
  • Representation rights
  • Processed transactions
  • Communication data (including e-mail correspondence)

1.2.2 For what purpose we process your data

We will process the personal data about you specified in Annex 1 for the following purposes:

  • To manage our customer relationships
  • To process transactions with our customers
  • To submit orders
  • To facilitate the logistical processing of our orders
  • To ensure the financing, processing, and settlement of payment transactions relating to orders
  • To communicate and manage the business relationship with customers/suppliers/business partners

1.2.3 Legal basis for data processing

We process your data on the basis of our overriding legitimate interest (Art. 6 [1] f of the General Data Protection Regulation), which consists of efficiently handling the business processes with our customers, suppliers, and business. We may ask for your consent to process certain types of your personal data in a separate document.

1.2.4 Transmitting your personal data

We will transmit your personal data to the following recipients to the extent that this is required for the purposes outlined above:

  • Our IT service providers
  • Customers, suppliers, and business partners to the extent required to render the agreed services

1.2.5 Retention period

We will store your personal data until the end of our business relationship with your employer (our customer/supplier/business partner), until the end of the statutory limitations or legal retention periods, or for as long as legal retention obligations apply. We will also retain your personal data until the end of any legal disputes for which the data are needed as evidence.

2 Transmitting data to other countries

Some of the recipients specified above are outside of Austria or process your personal data outside of Austria. The data protection standards in other countries may not correspond to those in Austria. We only transmit your personal data to countries that the EU Commission has determined to have an appropriate level of data protection, or we take measures to ensure that all recipients maintain an adequate level of data protection. To this end, we conclude standard contract provisions (2010/87/EC and/or 2004/915/EC), for example.

3 Your rights relating to personal data

The current laws afford you the rights to (i) ascertain if and what personal data we have stored about you and to obtain copies of these data, (ii) to demand that personal data about you be rectified, supplemented, or deleted when they are incorrect or are not being processed lawfully, (iii) to demand the limitation of the processing of your personal data, (iv) to object to the processing of your personal data under certain circumstances or to revoke the consent you granted to process your data, (v) to demand data portability, (vi) to obtain the identity of third parties to which your data are transmitted, and (vii) to file a complaint with the competent authority. The revocation of your consent to process your personal data has no effect on the lawfulness of data processing before revocation.
